A Final Judgment that pertains to parental responsibility, timesharing, child support or alimony may all be subsequently modified by a supplemental proceeding. A modification action may be brought when there is a substantial, material, unanticipated and permanent change of circumstances.
Parental responsibility or timesharing may be modified when a parent places the children in harm's way or fails to protect them.
Child support may be modified when a parent has an upward or downward change in income. Voluntary unemployment or voluntary underemployment are not favored in the law.
Likewise, alimony may be when a former spouse has an upward or downward change in income. Voluntary unemployment or voluntary underemployment are not favored in the law.
Relocation of one parent outside of 50 miles from the jurisdiction of the court requires that parent to seek court approval prior to any move to another location.
